Wu Club Terms and Conditions

1. Preamble

Talaria, which operates under the commercial name “VANESSA WU STORE”, SASU with capital of 10,000 euros, registered with the Paris RCS under number 811488576, whose head office is located 60, rue Amelot, 75011 Paris (France) (hereinafter Talaria), has developed and offers a fidelity program to its customers. The purpose of these general conditions (hereinafter the General Conditions) is to define the rights and obligations of Talaria and its customers in the context of the operation of this fidelity program, called “WU CLUB”.

2. Purpose of the “WU CLUB” fidelity program

The purpose of the “WU CLUB” fidelity program is, under the conditions and according to the terms set out below, to reward loyal Talaria customers by allowing them to accumulate fidelity points and to access, with these fidelity points, to advantages.

3. Scope of the “WU CLUB” fidelity program

The “WU CLUB” fidelity program is set up on the e-commerce website accessible at the address https://vanessawu.fr, operated by Talaria (hereinafter the Site), for the exclusive attention of customers individuals who make purchases on the Site. 

The “WU CLUB” fidelity program is therefore not open:

  • to Talaria's professional customers,
  • to employees of Talaria and its affiliated companies.

4. Conditions for membership in the “WU CLUB” fidelity program

Membership in the “WU CLUB” fidelity program is free, with no obligation to purchase, and open to any natural person aged at least 18 years or having the authorization of the authorized person acting in a personal capacity, residing in one of the countries from which it is possible to order on the Site, listed on the page https://www.vanessawu.fr/pages/livraison.

5. Terms of membership in the “WU CLUB” fidelity program

Membership in the “WU CLUB” fidelity program is carried out on the Site. To join, you must:

1. create a customer account on the Site via the “Create an account” page (https://www.vanessawu.fr/account/register) by providing the requested information, and at least a last name, first name and a valid email, then;

2. click on the “My Profile” tab via the “Account” page (https://www.vanessawu.fr/account) on the Site and check the box “I would like to register for the Wu Club fidelity program”.

It is specified that membership in the “WU CLUB” fidelity program is automatically offered after the creation of a customer account on the Site.

Membership in the “WU CLUB” fidelity program is confirmed to the member (hereinafter the Member) by email immediately after registration, on the condition that the mandatory information requested when creating the customer account is complete and exploitable. Talaria reserves the right to carry out, at any time, any checks that may prove necessary concerning the identity and/or contact details of applicants for membership.

Confirmation of membership in the “WU CLUB” program results in the creation of a dematerialized fidelity card, accessible via the Member’s customer account created on the Site.

Membership in the “WU CLUB” fidelity program is strictly personal. An individual can only join the “WU CLUB” fidelity program once. Talaria reserves the right to terminate the customer accounts and/or “WU CLUB” fidelity programs of any Member who has opened several customer accounts and/or holds several “WU CLUB” fidelity cards.

6. How the “WU CLUB” fidelity program works

The “WU CLUB” fidelity program allows any Member to accumulate fidelity points during purchases on the Site or via specific actions, and to consequently benefit from advantages and privileged offers, depending on the number points accumulated.

1. Prize pool

a. Accumulation of fidelity points in the prize pool

To accumulate fidelity points, the Member must first identify themselves on the Site, by connecting to their customer account. Points are then accumulated for each purchase made by the Member on the Site, according to the scale in force, and available in the virtual pool accessible via the Member's customer account.

The current scale for accumulating points is 1 point for 1€ of purchase on the Site. Talaria may modify this scale at any time, particularly during promotional operations. Information relating to the modification of the scale will be indicated in the Member's customer account and/or by email sent to the Member by Talaria.

In addition to the points accumulated during each purchase on the Site according to the scale in force, any Member can accumulate points thanks to the following actions:

  • Purchase of a gift card: any purchase of a gift card allows you to accumulate 15 fidelity points in addition to the points accumulated thanks to the purchase of the card according to the scale in force;
  • “Redonner” deposit: any “Redonner” deposit made under the conditions specified on the Site on the page https://www.vanessawu.fr/pages/redonner, can allow you to accumulate 30 fidelity points, provided when the Member submits a screenshot of their deposit via the page dedicated to the “WU CLUB” fidelity program accessible from their customer account on the Site, and subject to validation of this deposit by Talaria;
  • Photo with a Vanessa Wu product: by taking a photo with a “VANESSA WU” brand product marketed by Talaria, any Member can accumulate 30 fidelity points, provided they submit the photo via their customer account on the Site, and subject to validation by Talaria.

In addition, all Members automatically benefit from 50 welcome points when joining the “WU CLUB” fidelity program. 50 welcome points are also awarded to any Member reaching higher status under the conditions of article 6-2 of the General Conditions.

The accumulation of points is rounded up to the nearest euro and takes into account the amount of purchases made by the Member on the Site, net of discounts and discounts.

The accumulated points are visible immediately after each purchase in the prize pool appearing on the page dedicated to the “WU CLUB” fidelity program accessible on the Site, unless the Site is technically unavailable. In case of difficulty, and in particular in case that their fidelity points have not been accumulated in their prize pool after a purchase made on the Site, any Member can contact Talaria customer service by telephone at +33 (0) 1 76 58 04 54 or by email at shop@vanessawu.fr, within 12 months of purchase to assert their rights, upon presentation of appropriate proof of purchase.

b. Points validity period

The points accumulated by the Member in their prize pool are valid during the period of validity of the “WU CLUB” fidelity program as provided for in article 7 of the General Conditions, i.e. 12 months from the date of validation of the Member's membership in the program under the conditions of article 5 of the General Conditions.

After this period, the accumulated points not used by the Member will be lost and the Member's prize pool reset to 0. Unless the “WU CLUB” fidelity program is terminated at the Member's initiative or stopped by this program by Talaria under the conditions respectively provided for in articles 7 and 8 of the General Conditions, the fidelity program will continue under the same conditions for successive periods of 12 months during which the Member will again be able to accumulate points in their prize pool.

c. Consultation of the number of points and rewards acquired

Any Member can consult the status of their prize pool as well as all the information relating to their membership in the “WU CLUB” fidelity program on the Site via their customer account.

d. Point status in case of refund

Points accumulated during a purchase on the Site and subsequently giving rise to a refund or return of goods will be maintained and will remain credited in the Member's prize pool.

2. Benefits linked to the “WU CLUB” fidelity program

Depending on the number of fidelity points they have accumulated, the Member benefits from specific one-off or recurring benefits, as detailed in their customer account on the Site. Unless otherwise indicated, the advantages of the “WU CLUB” fidelity program cannot be combined with other offers or advantages offered by Talaria and announced on the Site.

The advantages and their conditions of obtaining are presented on the Site, on the page dedicated to the “WU CLUB” fidelity program as well as via the Member’s customer account. These benefits include:

  • Access to exclusive one-size-fits-all gifts (for example, but not limited to : water bottle, cocooning kit, bracelet, working girl kit, pair of socks, etc.);
  • Access to private offers and competitions;
  • Promotional offers.

The Member is also informed of this in the email confirming their membership.

To benefit from the exclusive gifts offered as part of the “WU CLUB” fidelity program, the Member must :

  • log in to their customer account on the Site;
  • exchange their fidelity points for the gift they wish to obtain, via the page dedicated to the “WU CLUB” fidelity program accessible from their customer account on the Site;
  • place an order on the Site and, once the order shopping cart is validated, add the gift they wish to obtain to the shopping cart of this order, via the drop-down menu available on the payment page.

It is specified that the Member can only receive an exclusive gift by placing an order on the Site, with only one gift per order. Gifts received in this way are neither returned nor exchanged.

Differentiated advantages have been put in place for the best Members of the “WU CLUB” fidelity program, through the following three statuses:

  • Wu Fan Status for any Member who has accumulated 0 to 399 points.
  • Wu Lover status for any Member who has accumulated 400 to 799 points.
  • Wu Addict status for any Member who has accumulated 800 points or more.

The Member has access to the benefits of each status for a period of 12 months. At this deadline, a new calculation will be carried out by Talaria.

7. Duration of membership in the “WU CLUB” fidelity program and terms of payment termination

Membership in the “WU CLUB” fidelity program is valid for 12 months from validation of the Member’s membership in the program under the conditions of article 5 of the General Conditions.

The Member who wishes to terminate their membership in the “WU CLUB” fidelity program before this date must make a request to Talaria customer service, by telephone at +33 (0)1 76 58 04 54 or by email at address shop@vanessawu.fr.

Any fraud, suspicion of tangible fraud, abusive use and/or non-compliance with the General Conditions and, more generally, any breach of the General Conditions may, at the discretion of Talaria, result in the definitive termination of the “WU CLUB” fidelity program with blocking of the fidelity account and loss of all rights and benefits attached to it, without entitlement to any compensation.

8. Modification / termination of the “WU CLUB” fidelity program

The “WU CLUB” fidelity program may be modified, suspended or deleted at the initiative of Talaria, in whole or in part, without notice.

Talaria may in particular modify its fidelity points calculation scale at any time.

No modification, including the deletion of the “WU CLUB” fidelity program, will entitle the Member to compensation. In case of termination of the fidelity program, Talaria will inform its customers through dedicated communication or by posting on the Site.

9. Anomaly/malfunction of the “WU CLUB” fidelity program

Talaria will make its best efforts to ensure that the Site is available 24 hours a day. However, it cannot be held responsible in case of interruption of the Site for technical reasons or in case of force majeure.

Talaria cannot be held responsible for the direct or indirect consequences of possible operating anomalies of the “WU CLUB” fidelity program beyond its control or which may relate to the advantages from which Members would have benefited, whatever the cause of these anomalies.

10. Complaints and information

For any information, complaint or question relating to the “WU CLUB” fidelity program, the Member is invited to contact Talaria customer service, by telephone at +33 (0)1 76 58 04 54, by email at shop@vanessawu.fr or via the form available on the Site in the “Contact” section.

Talaria is a member of FEVAD (Federation of Distance Selling Companies). As such, it undertakes to honor the rules contained in the professional code of the FEVAD quality charter, available on the site accessible at https://www.fevad.com.

11. Privacy policy

The personal data collected by Talaria as part of membership in the “WU CLUB” fidelity program are mandatory and necessary to enable the program to operate.

The Talaria company is responsible for processing the data collected.

Talaria's Privacy Policy, applicable as part of the “WU CLUB” fidelity program, is accessible on the Site at https://www.vanessawu.fr/pages/politique-de-confidentialite.

12. Modification of the General Conditions

Talaria reserves the right to adapt or modify the General Conditions at any time and without notice. The adaptations or modifications are then applicable to any use of the fidelity program subsequent to these adaptations or modifications.

13. Applicable law and competent jurisdiction

The General Conditions are subject to French law.

ALL DISPUTES TO WHICH THE GENERAL CONDITIONS COULD GIVE RISE, CONCERNING THEIR VALIDITY, THEIR INTERPRETATION, THEIR EXECUTION, THEIR RESOLUTION, THEIR CONSEQUENCES AND THEIR FOLLOW-UP WILL BE SUBMITTED TO THE PARIS COURTS.
